These Terms of Service ("Terms") govern your access to and use of the websites, products, and services (collectively, the "Services") provided by Setavia ("Setavia," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

Description of the Services

Setavia is an SEO analysis platform. The Services allow you to submit a website URL, after which Setavia crawls the publicly accessible pages of that website, analyses them using artificial intelligence, and generates SEO reports, content plans, and strategy recommendations. Access to full analysis features requires a paid subscription.

Eligibility and Account Responsibilities

You must be at least 18 years of age to use the Services. By creating an account, you represent that you meet this requirement. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Acceptable Use

You agree not to:

• Use the Services for any unlawful or prohibited purpose
• Submit websites for analysis that you do not own or have authorisation to analyse
• Interfere with or disrupt the Services or related infrastructure
• Attempt to gain unauthorised access to any part of the Services
• Use automated means to access or scrape the Services without permission
• Resell, redistribute, or sublicense the Services or any generated reports without our written consent

We reserve the right to suspend or terminate your account if you breach these Terms or use the Services in a manner that we reasonably consider harmful.

Subscriptions and Payments

Certain features of the Services require a paid subscription. Subscription fees are billed in advance on a recurring basis (monthly or annually) through our payment provider, Lemon Squeezy. All prices are displayed in GBP and are inclusive of applicable taxes unless otherwise stated.

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period, and you will continue to have access to paid features until that period expires. We do not offer free trials at this time.

Subscription fees are generally non-refundable. If you believe you are entitled to a refund due to exceptional circumstances, please contact us at billing@setavia.ai.

We reserve the right to change pricing with reasonable notice. Any price changes will apply to billing periods starting after the change takes effect.

Intellectual Property

The Services, including all software, content, features, and functionality, are owned by Setavia and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Services without our prior written consent.

You retain ownership of any content you submit through the Services (such as website URLs). By submitting content, you grant us a limited licence to crawl, process, analyse, and display that content solely for the purpose of providing the Services to you.

Reports and recommendations generated by the Services are provided for your use. You may use them for your own business purposes but may not resell or redistribute them as a standalone product.

AI-Generated Content

The Services use artificial intelligence to generate SEO analysis, content suggestions, and strategy recommendations. AI-generated outputs are provided for informational purposes and should not be treated as professional advice. We do not guarantee the accuracy, completeness, or suitability of any AI-generated content. You are responsible for reviewing and validating any recommendations before acting on them.

Data and Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Services, you acknowledge that you have read and understood our Privacy Policy.

If you cancel your subscription, we retain your account and analysis data for up to 12 months to allow you to reactivate. After this period, your data is permanently deleted.

Limitation of Liability

To the maximum extent permitted by law, Setavia shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Services.

The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to These Terms

We may update these Terms from time to time. Any changes will be reflected by updating the "Last updated" date at the top of this page. Continued use of the Services after any changes indicates acceptance of the updated Terms.
